User Responsibility & Confidentiality Agreement

1. Purpose and Scope

This User Responsibility & Confidentiality Agreement ("Agreement") establishes the obligations and responsibilities of all users ("You" or "User") accessing HR-Swipe ("Platform"). This Agreement is designed to protect the confidential information of all parties involved in the recruitment process, including candidates, recruiters, and employers.

2. Definition of Confidential Information

"Confidential Information" includes, but is not limited to: For Candidates: • Personal contact information • Resume and career history details • Salary information and expectations • Interview feedback and assessment results • Job application status For Recruiters and Employers: • Job requirements and descriptions • Compensation structures and budgets • Company strategy and plans • Candidate shortlists and evaluations • Internal hiring processes For All Users: • Platform algorithms and matching methodology • User analytics and behavioral data • Communication content between parties • Any information marked as confidential

3. Obligations of Users

As a User, you agree to: 3.1 Protection of Information • Keep all Confidential Information strictly confidential • Use Confidential Information only for legitimate recruitment purposes • Not disclose Confidential Information to unauthorized third parties • Implement reasonable security measures to protect Confidential Information 3.2 Proper Use • Use the Platform only for its intended purpose • Not misuse or exploit information obtained through the Platform • Report any suspected breaches or unauthorized access immediately • Cooperate with investigations into potential breaches 3.3 Professional Conduct • Maintain honesty and integrity in all interactions • Not engage in discriminatory practices • Respect the privacy and dignity of all parties • Communicate professionally and respectfully

4. Candidate-Specific Responsibilities

As a Candidate, you acknowledge and agree: • Information you provide about your qualifications is accurate and complete • You will not share recruiter or employer confidential information with competitors • You will notify us if your circumstances change (e.g., you accept another position) • You will respond to communications in a timely and professional manner • You will not use information about job opportunities for purposes other than applying

5. Recruiter-Specific Responsibilities

As a Recruiter, you acknowledge and agree: • You will use candidate information solely for recruitment purposes • You will not share candidate information without consent • You will not contact candidates for unauthorized purposes • You will provide accurate job and company information • You will handle rejection communications professionally and respectfully • You will comply with all applicable employment and data protection laws • You will not discriminate against candidates based on protected characteristics

6. Data Handling and Retention

You agree to: • Access only the information necessary for your legitimate purpose • Not download, copy, or store information beyond what is necessary • Delete or return Confidential Information when no longer needed • Not transfer Confidential Information outside approved systems • Comply with data retention policies and deletion requests

7. Prohibited Actions

You agree NOT to: • Share login credentials or allow unauthorized access • Screenshot, record, or capture confidential information for unauthorized use • Use information for competitive intelligence purposes • Sell, trade, or monetize Confidential Information • Contact users outside the Platform for unauthorized purposes • Attempt to identify anonymous or aggregated data • Circumvent security measures or access controls

8. Breach and Consequences

A breach of this Agreement may result in: • Immediate suspension or termination of your account • Legal action for damages caused by the breach • Reporting to relevant regulatory authorities • Liability for direct and consequential damages You agree to notify us immediately upon discovering any actual or suspected breach. Early notification may be considered a mitigating factor.

9. Disclaimer and Limitation

While we implement reasonable security measures, we cannot guarantee absolute security of information. You acknowledge that: • Transmission of information over the internet carries inherent risks • You use the Platform at your own risk • We are not liable for unauthorized third-party access despite reasonable precautions • You should implement your own security measures for sensitive information

10. Duration and Survival

This Agreement: • Takes effect upon your acceptance • Remains in effect while you use the Platform • Confidentiality obligations survive termination for a period of 2 years • Certain provisions (indemnification, limitation of liability) survive indefinitely

11. Amendments

We reserve the right to modify this Agreement at any time. Material changes will be communicated through: • Email notification to registered users • In-app notification requiring re-acceptance • Posted notice on the Platform Continued use after changes constitutes acceptance of modified terms.

12. Acknowledgment

By accepting this Agreement, you confirm that you have: • Read and understood all terms and conditions • Authority to accept on behalf of yourself or your organization • Received a copy of this Agreement for your records • Agreed to comply with all obligations stated herein
