Terms of Service

1. Acceptance of Terms
By accessing or using HR-Swipe ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.
These Terms constitute a legally binding agreement between you and HR-Swipe Pte. Ltd. ("Company", "we", "us", or "our"). We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting.
2. Eligibility
To use the Platform, you must:
• Be at least 18 years of age
• Have the legal capacity to enter into binding agreements
• Not be prohibited from using the Platform under applicable laws
• Provide accurate and complete registration information
For corporate accounts, you represent that you have authority to bind your organization to these Terms.
3. Account Registration and Security
You are responsible for:
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information is accurate and current
We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.
4. Acceptable Use
You agree NOT to:
• Provide false, misleading, or fraudulent information
• Impersonate any person or entity
• Use the Platform for any illegal purpose
• Attempt to gain unauthorized access to any part of the Platform
• Interfere with or disrupt the Platform's operation
• Scrape, harvest, or collect data without authorization
• Use automated systems or bots without explicit permission
• Harass, abuse, or harm other users
• Post discriminatory content based on race, gender, religion, or other protected characteristics
5. Candidate Responsibilities
As a candidate, you agree to:
• Provide accurate information about your qualifications, experience, and credentials
• Not misrepresent your skills, education, or work history
• Respond to recruiter inquiries in good faith
• Maintain professional conduct in all communications
• Keep your profile information current and accurate
6. Recruiter Responsibilities
As a recruiter, you agree to:
• Post only legitimate job opportunities
• Provide accurate job descriptions and requirements
• Respond to candidate applications in a timely manner
• Not use candidate information for purposes other than recruitment
• Comply with all applicable employment and anti-discrimination laws
• Maintain confidentiality of candidate information
7. Intellectual Property
The Platform and its original content, features, and functionality are owned by HR-Swipe Pte. Ltd. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain ownership of content you submit but grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with the Platform's operation.
8. Privacy and Data Protection
Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to our collection, use, and disclosure of your information as described in the Privacy Policy.
We comply with applicable data protection laws including the Personal Data Protection Act (PDPA) of Singapore.
9. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of information
We do not guarantee that the Platform will be uninterrupted, secure, or error-free.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HR-SWIPE SHALL NOT BE LIABLE FOR:
• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Any damages arising from your use of or inability to use the Platform
• Actions or content of third parties on the Platform
Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless HR-Swipe, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit to the Platform
12. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination:
• Your right to use the Platform ceases immediately
• We may delete your account and associated data
• Provisions that by their nature should survive termination shall remain in effect
13. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of Singapore. Any disputes arising from these Terms or your use of the Platform shall be resolved through:
1. Good faith negotiation
2. Mediation under the Singapore Mediation Centre
3. Binding arbitration under SIAC rules
You agree to submit to the exclusive jurisdiction of the courts of Singapore.
